Two challenges to the zoning changes for the proposed Einstein hospital at Woods Golf Center have been filed. Our legal team feels Einstein and the Township have committed multiple violations of the PA Sunshine Law and Municipalities Planning Code. It is not likely the ground breaking for this hospital can take place until all the legal challenges have made their way though the court system .... and that could take years.
On Wednesday, April 9, 2008, residents of East Norriton Township filed a lawsuit in the Montgomery County Court of Common Pleas against the East Norriton Township Board of Supervisors alleging violations of the Sunshine Act. The lawsuit pertains to the Township’s failure to follow the procedural requirements of the Sunshine Act during enactment of two municipal ordinances (Ordinances No. 505 and 506) enacted on March 10, 2008.

Additionally, on Monday, April 14, 2008, residents of East Norriton Township filed a substantive and procedural challenge before the Township Zoning Hearing Board under the Pennsylvania Municipalities Planning Code (MPC) arguing that the Township violated the procedural requirements of the MPC and that the zoning ordinances amount to spot zoning and contract zoning.
Whether you are against the hospital or for it, at the very least, you should be interested that all proceedings and decisions are legally done. This is not the case with the Einstein proposal. During discussions with the public regarding the Einstein proposal in the regular meeting of the East Norriton Board of Supervisors on March 25, 2008, Supervisor Staufenberg stated that if the public did not believe the township handled the Einstein rezoning process correctly, “then sue us.”
We have done so.
